Estate Planning
An “estate” is comprised of all of an individual’s assets, including real property, business interests, investments, insurance proceeds, personal property, and personal possessions. Estate planning is the preservation and distribution of one’s assets, both during one’s life and upon one’s death. The purpose of estate planning is to accomplish one’s personal and family goals, ease the management of one’s financial and legal affairs, and to minimize one’s tax burden.

Probate
“Probate” refers to the legal process through which an individual’s assets and possessions (the individual’s “estate”) are distributed after death. Generally speaking, in Colorado when a person (a “decedent”) dies, that person’s property is gathered and accounted for, lawful creditors are paid, and the person’s assets are distributed in accordance with the person’s wishes or pursuant to Colorado law, if the person died without a will. The administration of an estate is usually (but not always) carried out by a personal representative (also commonly referred to as an executor or administrator).
Both informal and formal probate actions must be open with the court for at least six months, but final administration could take considerably longer. At Baker Legal, we can assist you every step of the way.
